Term & Conditions

You may require creating an account and specify a password to use certain features. You agree to provide, maintain, and update true, accurate, current and complete information about yourself as prompted by the registration processes. You may not impersonate any person or entity or misrepresent your identification or affiliation with any person or entity, including using another person username, password, or other account information

You are entirely responsible for maintaining the confidentiality for your password and your account. And you are entirely responsible for all activity made by you or anyone that use your account. You agree to safeguard your password from access by others. If you believe your password had been compromised, you must immediately contact us.

The Platform allows you to make Sodakoq by placing an order for Food Vendor to prepare, such orders shall be delivered to you by Delivery Vendors, subject to the Terms & Conditions set out herein.

We do not own, sell or resell any food and does not control the Food Vendor, the Delivery Vendors or any services provided by them. You understand that any order that you place shall be subject to the product availability and delivery location serviceability of the Food Vendors and the Delivery Vendors.

All food order placed on the Platform are treated as confirmed. However, upon your successful completion of an order, we may call you on the telephone number provided or otherwise contact you to confirm the details of the order, any change in the order (for instance, due to unavailability), the price to be paid, any change in price of the order, and/or the estimated delivery time. For avoidance of doubt, the Company is not responsible for any separate arrangement between you and the Food Vendor and/or Delivery Vendor regarding the amendment and/or cancellation of orders made by you where such arrangement is not confirmed and recorded on the Platform.

Delivery of an order shall be made to the address specified by the user in its order.

We have the right at any time to sub-contract all or any of its obligations for the sale and/or delivery of the order to any other party as it may from time to time decide without giving notice of the same to the user.

Any dates quoted for delivery of the order are approximate only and delays may occur. The time for delivery/performance shall not be of the essence, and we shall not be liable for any delay in delivery or performance howsoever caused.

You shall not be entitled to cancel your order once you have received confirmation of the same.

We will have the right to not proceed with your order in the following circumstances:

• where the requested delivery location falls outside the delivery zone offered on the Platform;
• failure to contact you / your order receiver by phone or other means at the time of confirming the order;
• failure to deliver your order due to lack of information, direction or authorization from you / your order receiver at the time of delivery; or
• unavailability of all the items ordered by you at the time of ordering.

If you have an issue with your order delivery, please contact us immediately and inform us of your complaint via email support@sodakoqdelivery.my for an immediate response.

Upon assessment of your complaint, should we confirm that you are owed a refund, we will process your refund of payment.

You may choose to pay for the Services by online banking

The payment methods may also be subject to the following terms:

  • By choosing this payment method, you shall transfer the amount of the total purchase price for the order to our account (including any applicable taxes, and delivery fee). The transaction must be payable in Ringgit Malaysia. We may refuse this payment option service to anyone or any user without notice for any reason at any time.

You agree that this Agreement shall be subject to all prevailing statutory taxes, duties, fees, charges and/or costs, however denominated, as may be in force and in connection with any future taxes that may be introduced at any point of time. You further agree to use your best efforts to do everything necessary and required by the relevant laws to enable, assist and/or defend the Company to claim or verify any input tax credit, set off, rebate or refund in respect of any taxes paid or payable in connection with the Service supplied under this Agreement.

All intellectual property rights, whether registered or unregistered, in the Platform, information content on the Platform and all the website design, including, but not limited to, text, graphics, software, photos, video, music, sound, and their selection and arrangement, and all software compilations, underlying source code and software (collectively referred to as “Intellectual Property”) shall remain our property or where applicable, our affiliates or third party intellectual property owners. The entire contents of the Platform also are protected by copyright as a collective work under Malaysia copyright laws and international conventions. All rights are reserved.

You acknowledge and agree that the Platform may from time to time work with our partners to send you promotional messages, great deals or information from our sponsors.

The Platform may contain hyperlinks to third party websites. We do not control or endorse these third-party websites, or any goods or services sold on those websites. Some of these websites may contain materials that are objectionable, unlawful, or inaccurate. You acknowledge and agree that we are not responsible or liable for any Content or other materials on these third-party websites.

We provide the Platform and our services "as is" and without any warranty or condition, expressed or implied or statutory.

We make no representation, warranty, or guarantee as to:

• the Platform will be reliable, accurate, complete, or updated on a timely basis;
• the Platform will be free of human and machine errors, omissions, delays, interruptions or losses, including loss of data;
• any files available for downloading from the Platform will be free of infection by viruses, worms, Trojan horses, or other codes that manifest contaminating or destructive properties;
• any Content you post on the Platform will remain on the Platform; or
• the functions or services performed on the Websites will be uninterrupted or error-free or that defects in the Platform will be corrected.

In no event shall we be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our site, our services or this agreement (however arising, including negligence).

You agree to indemnify and hold the Company, its subsidiaries, affiliates, officers and independent vendors, harmless from any demand or claim, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of User’s use of the Platform, the violation of this Agreement, or infringement by User, or other user of the Platform using User’s computer, of any intellectual property or any other right of any person or entity.

You shall not use the Platform in any way that violates applicable federal, state, or international laws, regulations or other government requirements. You are responsible for compliance and assume all knowledge of applicable law and with any such laws. You further agree not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable state, local, national, or international law or regulation.

By using this website for transaction, you agreed that the Platform are not responsible for any losses arise from Fraud, Cheating or Scam from your bidding, buying, or direct negotiation or transaction conducted within buyers or sellers.

The Platform may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications including the device used by you or the Food Vendor or Delivery Vendor being faulty, not connected, out of range, switched off or not functioning. The company is not responsible for any delays, delivery failures, damages or losses resulting from such problems.

We have the right to terminate your account and access to the Platform for any reason, including, without limitation, if we consider your use to be unacceptable, or in the event of any breach by you of the Terms and Conditions. We may, but shall be under no obligation to, provide you a warning prior to termination of your use of the Platform.
